My name is John Hill and I'm a personal injury lawyer here in the TdsLAW.
I want to talk to you briefly about what to do if you're in an accident as a passenger in an Uber or Lyft vehicle or another ride-sharing type vehicle.
I have a lot of folks that come and ask me:
"Hey, I'm in an Lyft where the driver was responsible for the accident. Am I limited to the personal auto insurance policy that driver is carrying around on their personal vehicle when they're off doing personal things?"
And the answer to that question is NO.
When an Uber or Lyft driver is on the clock when they're actually doing a drive for Uber or Lyft they're carrying you as a passenger to a destination.
Uber and lyft have separate insurance that covers that driver. So if the driver of the Uber or Lyft is responsible for the accident and you're injured as a result we can sue Uber and Lyft.
We can sue that driver individually. Uber and Lyft have insurance to cover that driver. That is far in excess of what most drivers are driving around with. So it is helpful to get you fully compensated for your injuries.
But even if another person is responsible for the accident, even if you're in an Uber or a Lyft, and you're struck by another driver who's negligent Uber and Lyft also have what's called uninsured motorist insurance under the policies that they provide to their drivers.
So if you were in an uber or lyft and you were struck by another car and that party is responsible talk to a personal injury lawyer.
We have to actually sue the other driver first and exhaust that person's insurance policy.
But after we exhaust it we can make an uninsured motorist claim against Uber and Lyft under their insurance policy limits which are far more than hat most drivers in this state are driving around with. It allows you to get compensated for your injuries. So if you are in an Uber or Lyft accident, please contact a personal injury lawyer and let them know what happened. They can advise you of your rights if you haveany questions.
